The ACNC has a range of formal penalties and powers it can use in regulating charities, as well as being able to apply penalties. If we use of any of these formal powers we must publish this on the Charity Register.
We focus on guidance and education for charities. When we take compliance action and use our regulatory powers we consider the potential impact this could have on the charity and the community they serve.
This statement sets out the regulatory approach of the Australian Charities and Not-for-profits Commission. It explains to charities and other stakeholders how we regulate charities and guides ACNC staff in making appropriate and consistent decisions.
This report examines the ACNC’s compliance and enforcement activities between 1 January 2017 and 31 December 2017. It uses aggregated data and de-identified information to give readers an insight into the compliance work of the ACNC and outlines the compliance focus for the year ahead.
