The ACNC has published an updated Decision Impact Statement: Equality Australia Ltd, following public consultation and the Full Federal Court’s decision on the charity’s eligibility to be registered as a Public Benevolent Institution (PBI).
The statement reflects findings by the Administrative Appeals Tribunal and the Full Federal Court. It replaces the initial Decision Impact Statement (DIS) published on 1 November 2023, which was released while an appeal was before the court.
This is the first time the ACNC has consulted on a DIS, and all submissions welcomed the opportunity. Conducted earlier this year, it sought feedback on two draft documents: the updated Equality Australia Decision Impact Statement and a revised Commissioner’s Interpretation Statement on PBIs.
The updated DIS informs the sector of the ACNC’s view of the court decision and clarifies our regulatory approach.
